Legal briefs: April 7, 2010

The Board of Supervisors will hold a public hearing on the following matters at an adjourned meeting on April 14 at 6:30 p.m. in the Public Meeting Room of the Chesterfield Administration Building:

  • Ordinance amendments related to the definition of “kennel” and license taxes on kennels.
  • The exercise of eminent domain for the acquisition of a temporary construction easement and permanent drainage and utility easements for the Happy Hill Road Improvement Project across property at 13835 Happy Hill Road.
  • Ordinance amendments related to fees for adoption of sterilized animals and transfer of animals to animal rescue or humane societies.   

A copy of the proposed ordinance amendment is on file in the County Administrator’s Office and the Clerk to the Board’s Office at the Lane B. Ramsey Administration Building, 9901 Lori Road, for public examination between the hours of 8:30 a.m. and 5 p.m. of each regular business day.  For additional information, contact the County Attorney’s Office at 748-1491.
If further information about the exercise of eminent domain is desired, please contact R.J. McCracken, director of transportation, at 748-1037, between the hours of 8:30 a.m. to 5 p.m., Monday through Friday.

At adjourned meetings, the Planning Commission on April 20 at 6 p.m. and the Board of Supervisors on April 28 at 6:30 p.m., the boards will hold separate public hearings on the following matters in the Public Meeting Room of the Chesterfield Administration Building:

  • Amendments to the county’s zoning and subdivision ordinances needed in the wake of a recent Virginia Supreme Court decision. Among the proposed amendments to the zoning ordinance are those that: Increase the minimum lot size in the agricultural district from 1 acre to 5 acres, except for family subdivisions; increase the minimum lot width in the agricultural district from 150 feet to 300 feet, unless two lots share access, except for family subdivisions; and continue to allow family subdivisions with a minimum lot area of 1 acre and a minimum width of 150 feet. One of two proposed amendments to the subdivision ordinance removes a section – which the Virginia Supreme Cout determined to be illegal – that required the rezoning of property to a residential classification.

Copies of proposals may be reviewed Monday through Friday, 8:30 a.m. to 5:00 p.m., at the County Administrator’s Office and Clerk to the Board’s Office, Lane B. Ramsey Administration Building, and at the Planning Department, Community  Development  Building, 9800 Government Center Parkway. Hearings will be held at a public facility designed to be accessible to persons with disabilities.
